The Department of Health and Human Services (HHS) has added Fentanyl to the drug testing panel used for Federal workplace drug testing programs. This announcement now allows the Department of Transportation to add Fentanyl to the controlled substances that are part of the drug testing regimen for truck drivers. Those changes could be in place by mid-summer which will affect all tests performed after the effective date.
Prior to making the change, there was a comment period. Of the total 118 commenters, 115 supported the addition of fentanyl to the authorized drug testing panels. Most commenters noted the prevalence of fentanyl use and overdoses, based on their professional or personal experience, and the threat to workplace and public safety, particularly in transportation industries. Of the three individuals who disagreed: one incorrectly stated that fentanyl would be detected and reported using current opioid tests for Federal agency urine specimens; one incorrectly indicated that fentanyl would only be detected within a few hours of use; and the third disagreed with any additional Federal regulations for truck drivers.
